Terms & Conditions

Last Updated: September 8, 2026

Welcome to ash-ether.com (the “Site”), operated by AE Design, LLC, doing business as Ash + Ether (“Ash + Ether,” “we,” “us,” or “our”). By accessing or using this Site, you agree to these Terms & Conditions (“Terms”).

1. Website Use

This Site provides information about Ash + Ether, our floral and event design services, and products that may be available for purchase directly through the Site.

You may use this Site only for lawful purposes. You may not copy, reproduce, distribute, scrape, commercially exploit, or otherwise use Site content without our written permission.

2. Event Design Services

These Terms do not govern weddings, corporate events, private events, installations, event florals, bridal bouquets, personal flowers, rentals, styling, or other custom event services provided under a separate client agreement.

Those services are governed exclusively by the applicable written agreement between the client and Ash + Ether, including the approved estimate and any written addenda.

If there is any conflict between these Terms and a separately signed client agreement, the signed client agreement controls.

3. Standalone Floral Orders

These Terms apply to standalone floral arrangements, bouquets, seasonal offerings, and other products purchased directly through the Site and not included within a separately contracted event.

All floral products are individually designed using natural and seasonal materials. Photographs on the Site represent our style and design approach but do not guarantee an exact replication.

Specific flowers, colors, textures, vessels, greenery, and other materials may vary based on seasonality, availability, quality, and Designer judgment.

Ash + Ether reserves the right to make reasonable substitutions while maintaining the overall design intent, quality, and value of the order.

4. Order Acceptance + Availability

Submitting payment through the Site does not guarantee that an order can be fulfilled.

We reserve the right to decline or cancel an order due to product availability, delivery limitations, incorrect pricing or Site information, suspected fraud, circumstances beyond our reasonable control, or other legitimate business reasons.

If Ash + Ether cancels an order that we cannot fulfill, amounts paid for that order will be refunded.

5. Order Timing

Orders must be placed within the ordering windows or lead times displayed on the Site.

We cannot guarantee fulfillment of orders submitted outside those timeframes. Rush requests may be accepted at our discretion and may be subject to additional charges.

6. Cancellations + Refunds

Because our floral products are made to order using perishable materials, cancellation and refund availability depends on the status and timing of the order.

Once flowers, vessels, materials, or other products have been purchased or ordered specifically for your order, or production of your order has begun, the order is non-refundable.

Any cancellation request must be submitted directly to Ash + Ether as soon as possible. Approval of a cancellation or refund before materials have been purchased is at Ash + Ether’s discretion.

This section applies only to standalone floral orders purchased through the Site. Cancellation of weddings or other contracted events is governed by the applicable signed client agreement.

7. Delivery + Pickup

Delivery and pickup options, when available, will be shown at checkout or communicated directly following purchase.

Customers are responsible for providing complete and accurate delivery information, including addresses, recipient information, access instructions, gate codes, building information, and other details reasonably necessary to complete delivery.

Ash + Ether is not responsible for delays or failed deliveries caused by incorrect information, restricted access, recipient unavailability, unsafe conditions, weather, courier delays, or circumstances beyond our reasonable control.

If delivery cannot reasonably be completed, additional delivery or redelivery fees may apply.

Once an order has been delivered to the address provided, accepted by the recipient or another person at that location, placed in a reasonably safe location where appropriate, or picked up by the customer or recipient, responsibility for the floral product transfers to the customer.

8. Floral Care + Natural Materials

Flowers and botanical materials are natural, perishable products. Their lifespan varies based on variety, season, temperature, handling, water quality, environmental conditions, and care.

Ash + Ether does not guarantee a specific vase life.

After delivery or pickup, we are not responsible for deterioration caused by improper care, extreme temperatures, direct sunlight, lack of water, handling, transportation, pets, guests, or other environmental conditions outside our control.

Floral products are intended for decorative purposes and are not intended for consumption. Some flowers, foliage, berries, sap, pollen, or other botanical materials may cause irritation, allergic reactions, or may be harmful if ingested by humans or animals. Customers are responsible for keeping floral materials appropriately away from children and pets.

9. Payment

Payments for purchases made directly through the Site are processed through the payment services offered through our website platform.

Ash + Ether does not directly store complete payment card numbers.

Prices, applicable taxes, delivery charges, and other fees will be displayed at checkout when applicable.

10. Intellectual Property

The Ash + Ether name, Site design, written content, floral concepts, photographs owned by Ash + Ether, graphics, branding, and other original content displayed on this Site are owned by or licensed to AE Design, LLC and are protected by applicable intellectual property laws.

Nothing on this Site grants permission to reproduce, copy, sell, publish, commercially exploit, or use our content to market another business or service.

Images and content may not be used to represent another designer’s work or to commercially replicate Ash + Ether designs without written permission.

11. Third-Party Websites + Services

The Site may contain links to or integrate with third-party websites and services, including social media, booking, payment, and other platforms.

Ash + Ether does not control and is not responsible for the content, availability, security, terms, or privacy practices of third-party services.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Ash + Ether and AE Design, LLC will not be liable for indirect, incidental, special, consequential, or similar damages arising from use of the Site or a standalone floral order.

To the fullest extent permitted by applicable law, our total liability for a claim arising from a standalone Site purchase will not exceed the amount paid to Ash + Ether for the order giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

13. Circumstances Beyond Our Control

Ash + Ether is not responsible for delays or failure to perform caused by circumstances reasonably beyond our control, including severe weather, natural disasters, transportation disruptions, supply interruptions, crop or product failures, power outages, government actions, emergencies, or similar events.

If such circumstances affect an order, we may modify, postpone, substitute materials for, or cancel the affected order as reasonably necessary.

14. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.

Any dispute arising from these Terms or a Site purchase will be subject to the appropriate courts having jurisdiction in Boulder County, Colorado, except where applicable law provides otherwise.

15. Changes to These Terms

We may update these Terms periodically. Updated Terms will be posted on this page with a revised “Last Updated” date.

Changes apply prospectively and do not alter the terms applicable to an order already accepted before the updated Terms became effective.
